Waiver of Liability and Release

In consideration of participating in any activity, service, program, package, etc. and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence Brittnee Ann Fitness LLC DBA Fit Studio and its owners, directors, managers, officers, employees, trainers, instructors, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

I, ____________________________, have purchased in-person training sessions, online training programs/packages, class passes, nutritional plans, and/or another service or product offered from the Releasees, and agree to voluntarily participate in the purchased service.  I recognize that the exercise program includes, but is not limited to, aerobic exercise, strength training, stretching and flexibility work, and other various fitness activities under the Releasees’ guidance.  I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program or that may be aggravated by physical exercise.  If I do, I have spoken with my physician and have been cleared. I have fully informed the Releasees of all injuries (past or present)/limitations/precautions that need to be taken.  I acknowledge that my enrollment and subsequent participation is purely voluntary and in no way mandated by the Releasees.

I am aware that exercise and the use of equipment can be dangerous, even if completed properly.  I agree to follow the verbal instructions provided by the trainer.  I am aware of the risks and potential injuries that can occur, including, but not limited to: fainting, changes in heartbeat, neck/spinal injuries, as well as injuries to all bones, joints, ligaments, tendons, and muscles, or any other illness or soreness that may incur, including death, etc.

The Releasees or I will be supplying the equipment used in our workouts, including, but not limited to benches, dumbbells, barbells, etc.  I understand that if I supply any equipment, the Releasees are to not be held responsible for its condition.  The Releasees have not inspected my equipment, and therefore do not know its conditions.  I understand that the Releasees will take precautions to maintain equipment, but any equipment could malfunction and cause injury at any time.  I take sole responsibility to inspect all equipment before use and express my concern to the Releasees if I do not feel safe using any equipment.

I understand I am responsible for my own medical insurance while participating in any service/program offered by the Releasees.  I will accept any additional charges that go beyond my health coverage.  I will immediately notify the Releasees of any significant injury requiring medical attention.

Even though the Releasees will take all possible precautions to ensure my safety, I will assume and accept sole responsibility for my actions, safety, and any injuries that may occur at any training location (including but not limited to, Fit Studio, in-home, in public, etc.).  I waive and release any and all claims against the Releasees.  I agree to hold the Releasees harmless for any claims or losses that include but are not limited to, negligence for any injuries or expenses that may occur.  These clauses will apply to all activities that occur during the time I participate in services from the Releasees.

I understand that I am required to give 24 hour notice for any cancellations or will be required to pay for that session/class. (All sales are final. Payment is required to reserve a spot/schedule an appointment.)

I am signing this agreement freely and willfully, not under fraud. I have read and fully understand this document and agree to be bound by its terms.

BY SIGNING THIS DOCUMENT, I AGREE THAT IF I AM HURT OR MY PROPERTY IS LOST, STOLEN, OR DAMAGED DURING MY PARTICIPATION IN THIS ACTIVITY, THEN I MAY BE FOUND BY A COURT OF LAW TO HAVE WAIVED MY RIGHT TO MAINTAIN A LAWSUIT AGAINT THE PARTIES BEING RELEASED ON THE BASIS OF ANY CLAIM FOR NEGLIGENCE.

I HAVE READ ALL THE ABOVE TERMS AND INTEND TO BE HELD LEGALLY BOUND AND UNDERSTAND THAT THIS DOCUMENT IS A COMPLETE WAIVER AND DISCLAIMER IN FAVOR OF THE RELEASEES.

In consideration of ___________________________ (PRINT minor’s name) being permitted to participate in this activity, I further agree to indemnify and hold harmless the Releasees from any claims alleging negligence which are brought by or on behalf of minor or are in any way connected with such participation by minor.
